At the end of 2023, the Court of Justice of the European Union issued three sports-related judgments: European Super League, International Skating Union, and Royal Antwerp. In these judgments, the Court expands on the requirements that sport governing bodies and other private actors that “collectively regulate” markets (e.g. trade unions and professional organisations) must respect under EU internal market law. This carries generell, long-term, and potentially far-reaching consequences for private norm making, far beyond the specific issue of so-called breakaway leagues in European footboll.
