The EU right to an effective remedy in Article 47 CFR applied in Swedish courts

Seminar with Johanna Engström. Johanna Engström holds a doctorate in European law from the European University Institute in Florence. Starting in 2010, she has worked at DG Justice of the European Commission, inter alia with questions on gender discrimination and EU criminal law.

This seminar will discuss how Swedish courts, empirically, have applied Article 47 of the Charter of Fundamental Rights as well as the general principle of effective judicial protection in their case-law since 2009.


It will examine the case-law from all different levels of Swedish general and administrative courts from a qualitative and quantitative perspective with an aim to understand how the principles have unfolded in the Swedish legal habitat the last ca 15 years.


The approach of Swedish courts to the principle will be discussed. It will raise questions such as how the judiciary has taken on the role that the principle confers on judges, what difficulties have arisen and to what extent Swedish judicial culture has played a role in the application of the principle and in the fulfilment of the overall task of the judiciary to ensure an effective enforcement of EU law. The Swedish courts’ approach to using preliminary references in this specific area will also be explored. The seminar will try to answer whether Article 47 of the Charter has, or is about to take its rightful place in the Swedish legal environment.
