Participation in EU law-making through consultation - achieving coherence

At the seminar, Gloria Golmohammadi will present a draft of selected chapters from her doctoral thesis. After a short presentation, the opponent at the seminar, Jur.dr. Anna Wallerman, Associate Senior Lecturer at Gothenburg University, will comment the manuscript. Subsequently, there will be time for questions and discussion.

The importance of individual and institutional participation in decision-making processes is successively being highlighted in various fora. At the same time, the EU legal and institutional framework is challenging traditional forms of engagement at the national and local level. For instance in Sweden, the formal public and stakeholder consultation process is often activated during the phase of implementation rather than negotiation of EU legislative acts. The legal ramifications of law-making consultation is also complex and influenced by the EU multi-level legislative dynamic. At the seminar research findings will be presented in relation to the question: What legal principles and rules govern the EU commission’s consultations and the Swedish consultation procedure (remissförfaranden) in relation to EU law-making? In this context recent case law from the CJEU and Swedish courts will be discussed including the 2018 Swedish Supreme Court judgment assessing the legality of the government’s legislative consultation.
